[119] Robert's estate was administered by Thomas Fryth de Eyam Myner et Guilielmus Fryth de eade Weaver - Thomas Fryth being "the Nephew & next of kinsman by blood to Robert Whitely late of Eyam... by reason of the death of John & Mary Whitely Children & Executors in the Will of the sayd decd." Both sign, in the presence of Simonis Marten Jun, Notarij Publei. From the Staffordshire Name Indexes Website: "If someone died without making a will (intestate), the court had the authority to appoint administrators. Usually, this would be next of kin - wife/husband, child/children, parent, brother/sister and so on". It would appear that the same situation aplies if the executor(s) of an extant Will die before being able to prove the Will, as was the case here. As it says specifically Thomas was Robert's next of kinsman by blood, and as Robert's wife, child (or children) and parents, and any brothers or sisters he had were also dead, it seems reasonable to assume that Thomas was the son of one of Robert's sisters, and not a relation of his second wife (also named Frith). [120] Henry is a bit of a mystery. Evidently, however he was the son of Robert "Whittle", as both of them receive bequests in the Will of Christopher Hibbert alias Chapmam of Eyam "Lead Myner", probated 25 Apr 1632 - "fourteene shillings to my said father in law Robt Whitle & the rest of the said fortie shillings to Henrie Whitle my brother in law". Robert was also Christopher's executor, and for his pains he also got "me best breeches". Also named in the Will were Christopher's wife Elizabeth, their daughter Ellin, who was under 16, and his "brother" (in law, presumably) Francis Yellot, who was to receive the first portion (fourteene shillings) of the said fortie pounds. Those amongst us who can do "Hard Sums", will immediately realise that Henry received 2 pounds less than the other two, but in dividing it into an exact amount of pounds, instead of 3 shares of UKP13 6s. 8d, someone had to lose out, I suppose. He leaves his nephew Robert Whyteley of Eyam UKP6, "on condition that he shall or will quiettly & peaceably depart & remove out of my house wherein he now dwelleth, and if he doesn't, my execs to put or drive him out by law". Other bequests are to his kinswoman Ann wife of Georg Moss, William Frith of Eyam, Bridgitt wife of Samuel Johnson of Ashford, Joane wife of Gervas Eyar of Tid(es)well, Margaret wife of Robert Thorpe, Robert son of Tho: Frith to have "my best Coate & my best Dublett", and Arthur Skidmore. And finally all the rest of his estate "both reall & psonall together wth my dwelling house kitchen & barnel..." was to go to Thomas Frith of Eyam myner, who he also appointed as executor.
